Terms of Service

These Terms govern your use of Snacked, a quiz-funnel SaaS operated by SOFTWARY S.R.L., an Italian limited liability company with registered office at Via Giovanni Porzio F11, 80143 Napoli (NA), Italy, VAT number IT10580571213 (“Snacked”, “we”, “us”). By creating an account or using the service you agree to them.

1. The service

Snacked lets creators publish AI-generated quiz-style lead funnels. The exact features, capacity limits and supported integrations are those documented on snacked.it/pricing and inside the product itself. We may add, remove or change features over time; see §10.

2. Plans and billing

We offer a Free plan and paid plans. Plan features, capacity limits and prices are those currently displayed on snacked.it/pricing at the time you subscribe.

Recurring paid plans renew automatically for the billing period you select (e.g. monthly or annual) until you cancel. One-time lifetime purchases grant the feature scope of the corresponding tier for the operational life of the service, subject to changes necessary to keep the platform running.

Billing, VAT collection and invoicing are handled by our payment partner on our behalf. The partner's identity is disclosed at checkout, on your invoice, and listed as a sub-processor in our Privacy Policy. We reserve the right to change payment partners; any change is invisible to you beyond the name on your bank statement.

All purchases are processed by our payment partner Paddle.com Market Limited, acting as Merchant of Record. Refunds are governed by Paddle's Refund Policy, available at paddle.com/legal/refund-policy. Customers in the EU, EEA, United Kingdom and Switzerland are entitled to a full refund of any purchase within 14 days from the date of purchase. Customers in other regions are entitled to refunds within the windows specified in Paddle's Refund Policy. To request a refund, use the refund link on your Paddle invoice or contact support@snacked.it.

On cancellation, access continues through the end of the paid period; after that, quizzes are suspended and lead data stays read-only for the retention window described in the Privacy Policy.

3. Acceptable use

You may not use Snacked to harvest emails for unsolicited marketing, run quizzes that violate anyone's privacy, target minors without appropriate guardianship, or generate content that breaks applicable law. We may suspend or terminate accounts at our discretion for violations and will provide a reason when feasible.

4. AI-generated content

Quiz copy generated by the AI is provided as a starting point. You are responsible for reviewing, editing and publishing it. We make no guarantees about accuracy, originality, suitability or fitness for purpose. You retain ownership of the final content you publish and of any edits you make.

5. Lead data ownership

You own the lead data your quizzes capture. We process it on your behalf as a GDPR data processor — see the Privacy Policy and the DPA available on request. We will not sell, share or repurpose your leads, and we will not use them to train third-party AI models.

6. Service availability

The service is provided “as is”. We do not offer a contractual SLA at this stage. We aim for high availability but make no specific uptime guarantee. Scheduled maintenance is announced in advance when feasible.

7. Termination

You may delete your account at any time from /settings/account. A grace period applies before permanent erasure (see Privacy Policy §5). We may terminate or suspend access for violations of §3 or for non-payment.

8. Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the service is capped at the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, special or exemplary damages, including loss of profits, leads, data, or goodwill.

9. Governing law

These Terms are governed by Italian law. Any dispute is resolved in the courts where the publisher is registered, unless EU consumer protection law assigns an alternate venue to you.

10. Changes

We may update these Terms, our pricing, our feature set, our sub-processors and our payment partners from time to time. Substantive changes that affect paying customers (material price increases, removal of features you are using, jurisdiction changes) will be announced by email at least 14 days before they take effect for your account. If you do not wish to accept a substantive change, you may cancel your subscription before it applies; the Paddle Refund Policy referenced in §2 continues to govern any refund eligibility.

Non-substantive changes (clarifications, formatting, additions of new optional features) take effect when published, with the “Last updated” date refreshed. Continued use after that date constitutes acceptance.

11. Referral and promotional incentives

From time to time we may offer referral or promotional incentives (capacity bonuses, discounts, lifetime credits). The terms of each offer — eligibility, amounts, expiry, anti-abuse rules — are those published on the relevant product page at the time you participate. Incentives are non-transferable, have no cash value, and may be revoked or adjusted if we detect abuse (fake signups, self-referral, chargebacks of referred conversions).
